<p>Indexation des baux commerciaux.</p>
<p>L'article 47 de la loi de modernisation de l'économie (n°2008-776) du 4 août 2008 instaure l'indice des loyers commerciaux (ILC).</p>
<p>Depuis la loi 2014-626 du 18 juin 2014 (article 9) qui la modifie, et l'article L145-34 du code de commerce en résultant, deux indices peuvent être utilisés pour la révision des baux professionnels :<br />
- l'indice des loyers commerciaux pour les activités commerciales ou artisanales ;<br />
- l'indice des loyers des activités tertiaires pour les activités tertiaires autres que commerciales exercées dans des locaux professionnels, dont en particulier les professions libérales et les activités exercées dans des entrepôts logistiques.<br />
Le décret n°2008-1139 du 4 novembre 2008, relatif à l'indice trimestriel des loyers commerciaux, définit les modalités de calcul et de publication de cet indice, ainsi que les activités concernées.</p>
<p>Le décret n°2022-357 du 14 mars 2022 modifie le décret n°2008-1139 du 4 novembre 2008, relatif à l'indice trimestriel des loyers commerciaux, conformément aux articles 2 à 5. Il modifie notamment la formule de calcul de l'ILC.</p> |

<p>Indexing of commercial rents.</p>
<p>The article 47 of Act no. 2008-776 on the modernization of the economy of 4 August 2008 introduced the Commercial Rent Index (ILC).</p>
<p>Since the Act 2014-626 of 18 June 2014 (Article 9) which amends the former act and the article L145-34 of the Commercial Code resulting, two indices may be used for the purpose of indexing commercial property rents:<br />
- The Commercial Rent Index (CRI) for commercial and craft activities;<br />
- The Tertiary Activities Rent Index (TARI) for services activities other than commercial which are carried on in business premises, including in particular professions and activities in logistics warehouses.<br />
Decree no. 2008-1139 of 4 November 2008, relating to the Commercial Rent Index, defines the calculation and publication procedures for this index, in addition to the activities concerned.</p>
<p>Decree n°2022-357 of 14 March 2022 alters Decree n°2008-1139 of 4 November 2008 relating to the quaterly Commercial Rent Index, according to articles 2 to 5. It changes in particular the formula for calculating the Commercial Rent Index.</p> |
